All charges stemming from two alleged drunken incidents involving former dual-code international footballer Wendell Sailor have been dismissed by a Sydney court, with the proceedings diverted under mental health provisions. The former NRL and Wallabies star faced multiple charges following separate events in Sydney’s CBD and Wollongong.
In 2024, Sailor was initially charged with two counts of common assault and other related offences. These charges arose after he allegedly refused to leave a licensed venue in Sydney’s central business district. Reports indicate that the ex-Brisbane Broncos and Wallabies winger remained in the vicinity of Pappy’s Bar on Erskine Street after being denied service due to his behaviour.
The legal proceedings also encompassed charges from an alleged drunken night at a bar in Wollongong during the previous year. The court was informed that Sailor’s conduct during this incident included “aggressive” behaviour directed towards a taxi driver, and he was also accused of resisting arrest when police were called to the scene.
Mental Health Provisions Utilised
In the Downing Centre Local Court, Magistrate Jennifer Atkinson stated that she was satisfied Sailor’s case met the criteria for diversion under Section 14 of the Mental Health Act. This legislation empowers magistrates to redirect defendants who are experiencing mental health impairments away from the standard criminal justice system and towards appropriate care.
Magistrate Atkinson referenced a report from Dr. Sathish Dayalan, a consultant forensic psychiatrist, which indicated that Sailor was likely suffering from a major depressive disorder at the time of the alleged offences. “His excessive alcohol use was probably a by-product of his disorder,” the Magistrate observed, suggesting a complex interplay between his mental state and substance consumption.
A Path to Recovery and Treatment
The court heard that Wendell Sailor has actively engaged in psychiatric treatment and commenced therapy sessions following the second alleged incident in Wollongong. This therapeutic journey began at the start of the current year, marking a significant step towards addressing his well-being.
It was also disclosed to the court that Sailor had already entered guilty pleas to three offences connected to the two separate incidents. This acknowledgement of responsibility formed part of the proceedings.
Comprehensive Health Plan Accepted
Magistrate Atkinson expressed her acceptance of the detailed health plan presented by Sailor’s legal representative, Adam Houda. This plan is designed to manage both Sailor’s mental health challenges and his issues with alcohol consumption.
The Magistrate highlighted that Sailor had no prior criminal record before these two incidents occurred. This absence of previous convictions was noted as a relevant factor in the court’s decision.
Furthermore, Ms. Atkinson acknowledged the personal difficulties Sailor had faced, including the recent death of his mother and the dissolution of a significant relationship. These personal circumstances were considered within the broader context of his mental health.
Charges Dismissed, Care Ensured
Ultimately, Magistrate Atkinson announced her decision to dismiss all charges against Wendell Sailor. He has been discharged into the care of his General Practitioner, with the explicit requirement to adhere to his established treatment plan. This outcome prioritises Sailor’s recovery and ongoing management of his mental and behavioural health.
